Many times I get a -- I get calls from clients who ask whether or not they should leave the house. They’re contemplating a divorce and their spouse wants them to move out, should they do it.

Well the question is a somewhat complicated one in the sense that there is a, an answer to the legal question but there are answers to the practical questions as well.

Legally if you leave your house you don’t give up any of your rights to the house, to your children or to anything. Sometimes leaving the house is a practical solution that makes a great deal of sense for everybody because it may help to reduce the stress and anxiety of everybody in, in the family which will help to make the case go a little bit smoothly.

But there are other times when it would be detrimental for tactical reasons to leave the house and those would have to be explored on an individual basis.
